Can a co-ownership be managed without a professional manager in Luxembourg?

A small co-ownership can be administered by one of the co-owners, appointed by the general meeting. Synila provides the accounting and administrative tools to do so. The applicable rules and thresholds are described on guichet.public.lu.

Do you need accounting knowledge?

The tool calculates the allocation and the annual statement from the ownership shares. Responsibility for the accounts of the co-ownership and for presenting them to the general meeting remains that of the appointed manager (Articles 5 and 24 of the Grand-Ducal Regulation of 13 June 1975, Mémorial A No 34 of 20 June 1975). Sums received in the name and on behalf of the co-owners association must moreover be paid without delay into an account opened in the name of that association (Article 28 of the same regulation).

Does the price depend on the number of units?

Synila offers a plan designed for small co-ownerships. The price is set according to the situation; get in touch to obtain a quote.

Can you start from your old system's export files?

Synila provides for the import of the data from an export of your old system or an existing mandate — ownership shares, balances, history — to carry on without re-entering everything. The scope actually taken over depends on the formats available and is subject to a prior review.

Do the other co-owners have access to the information?

Yes. Each authorised co-owner sees what concerns them: calls for funds, statements and documents, all in one place.

Is a works fund required in a small co-ownership?

Yes. The works fund is mandatory for all residential co-ownerships, whatever their size. Synila keeps it separate from the running charges.

You live in a co-ownership of 2 to 9 units and take on the role of voluntary manager: Synila lets you share information with the other co-owners, simply. This 2-to-9-unit threshold is the commercial scope of the offer, not a legal threshold: the Law of 16 May 1975 applies whatever the size of the co-ownership, and the nine-unit threshold concerns an exemption from the business permit for a co-owner who personally acts as manager — neither an exemption from having a manager, nor an exemption from the law.

Synila is a separate software solution, currently presented on the Petzerhiel website during its development phase.

When the spreadsheet reaches its limits

Many small co-ownerships are run with a spreadsheet, supplemented by a host of separate tools: exchanges with the other co-owners and the trades are not kept, invoices are stored nowhere, the history is long to reconstruct and the allocation of charges is recalculated by hand. Synila brings these tasks together and keeps them up to date, without assuming any particular accounting skills.

A Luxembourg framework, data kept in the country

Synila is designed to follow the Luxembourg framework: the majorities of Articles 15 to 17 of the law of 16 May 1975, a suitable chart of accounts, a works fund separate from the running charges within the meaning of Article 11bis, the fifteen-day convening deadline provided for in Article 3 of the Grand-Ducal Regulation of 13 June 1975. Responsibility for the compliance of the convening notices and of the decisions remains that of the manager. And your data is hosted in Luxembourg, at the Technopolis data centre in Cessange, operated by NETsite.lu SARL, with access-rights management by profile and access logging.

For each co-owner, Synila shows what has been called, paid and is due. Running charges and the works fund stay separate: a balance does not mix an operating advance with the mandatory works fund.
